These Terms and Conditions ("Terms") govern your access to and use of winningvocal.com (the "Site") and the AI voice receptionist and messaging services offered by Winning Vocal, a registered DBA of World Services and Sales LLC ("Company," "we," "us," or "our"). By accessing the Site or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or the Services.

1. Company and DBA Disclosure

Winning Vocal is a registered DBA of World Services and Sales LLC. All references to "Winning Vocal," "we," "us," or "our" in these Terms refer to World Services and Sales LLC doing business as Winning Vocal.

2. Description of Service

The Services consist of AI-powered voice receptionist agents and related workflow automation, built for businesses in hospitality and services industries, including answering inbound calls, scheduling appointments, and summarizing call activity on behalf of our business clients ("Clients"). The Site also offers a demonstration of the Services to prospective Clients.

3. SMS and Text Messaging Terms

As part of the Services, you may receive text messages related to your inquiry, appointment, or account, including:

Message frequency varies depending on your interactions with the Services. Message and data rates may apply. You may opt out of text messages at any time by replying STOP to any message. For help, reply HELP, or contact us using the information in Section 10, "Contact Us."

4. Payment and Cancellation

Fees for the Services are agreed upon directly with Clients under a separate service agreement or order form. Where a subscription or recurring fee applies, it will be described in that agreement, including billing frequency and cancellation terms. Clients may cancel their subscription according to the terms of their service agreement; cancellation requests should be directed to your Winning Vocal account contact or to the information in Section 10, "Contact Us."

5. Acceptable Use

You agree not to use the Site or the Services for any unlawful purpose, to transmit unsolicited messages in violation of applicable law, or to interfere with the operation of the Services.

6. Disclaimers

The Services, including AI-generated call handling, are provided "as is" and "as available." While we work to ensure accuracy and reliability, we do not guarantee that the Services will be uninterrupted, error-free, or that AI-generated responses will always be accurate.

7. Limitation of Liability

To the fullest extent permitted by law, World Services and Sales LLC (d/b/a Winning Vocal) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or the Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Services will not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

8. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Nevada.

9. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site or the Services after changes take effect constitutes acceptance of the revised Terms.
